The question before this Court is whether an employee can set forth a valid cause of action against his employer under the personal animus exception to the Pennsylvania Workmens Compensation Act ("Act"), for non-work-related injuries inflicted by a co-worker solely for personal reasons, where the injured employee has previously accepted benefits pursuant to the Act. We hold that only a final adjudication of work-relatedness can estop an employee from asserting that his injuries are not work-related for purposes of maintaining an action against his employer under the personal animus exception to the Act.
